Common use of Operators' Sole Responsibility Clause in Contracts

Operators' Sole Responsibility. Except as otherwise provided in Section 11(f) (Specified Level Damages) and Section 11(g) (Substance Abuse Exceptions), each Operator shall assume and bear all responsibility for Damage to its own trains, locomotives and equipment, to Railcars and lading in its possession or being handled for its account and for the death of or injury to its own employees.
