Common use of Optional Retransfers of Home Equity Loans Clause in Contracts

Optional Retransfers of Home Equity Loans. Pursuant to Section 2.3 of the Home Equity Loan Purchase Agreement, the Servicer, in its capacity as Seller, may, but shall not be obligated to, require the retransfer of Home Equity Loans from the Trust to the Seller as of the close of business on a Transfer Date after giving notice to the Indenture Trustee on the Notice Transfer Date. Any such retransfers shall be permissible only upon the satisfaction of the conditions set forth in Section 2.3 of the Home Equity Loan Purchase Agreement.
