Common use of Options and Other Rights Clause in Contracts

Options and Other Rights. (a) The Servicer shall take such action as it shall deem reasonably necessary or appropriate with respect to the exercise by any Lessee of any option or right affecting any Asset according to the terms of the related Asset Document; and (b) The Servicer is authorized to take such action as it shall deem reasonably necessary or appropriate with the approval of WEST if so required by Section 7.06 or any other Person in the Serviced Group or, if time is of the essence, without such approval, with respect to the exercise on behalf of any Person within the Serviced Group of any right or option that any Person within the Serviced Group may have with respect to any of the Assets provided that such exercise is in accordance with the terms of the relevant Asset Document.

(a) The Servicer shall take such action as it shall deem reasonably necessary or appropriate with respect to the exercise by any Asset Lessee or Loan Asset Borrower of any option or right affecting any Asset according to the terms of the related Asset Portfolio Document; and and (b) The Servicer is authorized to take such action as it shall deem reasonably necessary or appropriate with the approval of WEST the Borrower if so required by Section 7.06 7.04 or any other Person in the Serviced Group or, if time is of the essence, without such approval, with respect to the exercise on behalf of any Person within the Serviced Group of any right or option that any Person within the Serviced Group may have with respect to any of the Assets provided that such exercise is in accordance with the terms of the relevant Asset Portfolio Document.
