Common use of Order of Precedence; Incorporation by Reference Clause in Contracts

Order of Precedence; Incorporation by Reference. Any inconsistency or ambiguity in this Contract shall be resolved by giving precedence in the following order: (1) this Contract; (2) any written notices given by the State to the Contractor (including any attachments thereto) pursuant to Section 30 of this Contract; (3) Attachment 1; (4) Exhibit 1 (which will be described below in Section 53 of this Contract); (5) the most current form of DCS’ Service Standards, DCS’ Child Welfare Principles, and the Assurances (which are described in Section 1(B)(2), Section 1(B)(3), and 1(C) of this Contract); (6) the Community-Based Services RFP; and (7) the Contractor's RFP Response. All attachments, and all documents referred to in this paragraph, are hereby incorporated fully by reference.
