Organics Processing Facility. CONTRACTOR shall deliver all 954 collected Organic Waste to a legally permitted Organics Processing Facility as listed in 955 Exhibit 5. In the event the facility is closed on a Work Day, or is not able to accept Organic 956 Waste, the CONTRACTOR shall transport and deliver the Organic Waste to such other 957 legally permitted facility as is approved by TOWN. CONTRACTOR shall ensure that all 958 Organic Waste collected pursuant to this Agreement, except Processing Residue, is 959 diverted from the Disposal Facility in accordance with AB 939, AB 1826 and subsequent 960 legislation and regulations.
