Common use of Originating Goods Clause in Contracts

Originating Goods. 1. Except as otherwise provided in this Chapter, the following goods shall be considered as originating in a Party: (a) goods wholly obtained or produced in a Party as defined in Article 3.3 (Goods Wholly Obtained); (b) goods produced in a Party exclusively from originating materials; or (c) goods produced from non-originating materials in a Party, provided that the goods conform to a regional value content of no less than 40%, except for the goods listed in the Annex II (Product Specific Rules of Origin) which must comply with the requirements specified therein.

Originating Goods. 1. Except as otherwise provided in this Chapter, the following goods shall be considered as originating in a Party: (a) goods wholly obtained or produced in a Party as defined in Article 3.3 3.2 (Goods Wholly Obtained); (b) goods produced in a Party exclusively from originating materials; or (c) goods produced from non-originating materials in a Party, provided that the goods conform to a regional value content of no less than 40%, except for the goods listed in the Annex II 3-A (Product Specific Rules of Origin) which must comply with the requirements specified therein; and meet other applicable provisions of this Chapter.
