Other Agreements; No Default. Borrower has no material contracts, agreements, leases or commitments which have not been previously disclosed to Lender. Borrower is not in default in any respect in the performance, observance, or fulfillment of any of the obligations, covenants, or conditions contained in any contract, agreement, lease or instrument to which Borrower is a party to the extent that such default would have a Material Adverse Effect. Borrower enjoys peaceful and undisturbed possession under all leases to which it is a party.
