Common use of Other Business Activities of the Holders Clause in Contracts

Other Business Activities of the Holders. Each Holder acknowledges that each other Holder and/or any of its Affiliates may make loans or otherwise extend credit to, and generally engage in any kind of business with, any Borrower Party and/or any entity that is a holder of debt secured by direct or indirect ownership interests in any Borrower Party or any entity that is a holder of a preferred equity interest in any Borrower Party, and receive payments on such other loans or extensions of credit to any Borrower Party and otherwise act with respect thereto freely and without accountability in the same manner as if this Agreement and the transactions contemplated hereby were not in effect.

Other Business Activities of the Holders. Each Holder acknowledges that each other Holder and/or any of its Affiliates party hereto may make loans or otherwise extend credit to, and generally engage in any kind of business withwith the Borrower, its Affiliates, any Borrower Party and/or any entity that is a holder of debt secured by direct or indirect ownership interests preferred equity in any Borrower Party the Borrower, or any entity lender that has foreclosed or is a holder in process of a preferred equity interest in foreclosure or comparable conversion on any Mezzanine Loan (collectively, “Borrower PartyRelated Parties”), and receive payments on such other loans or extensions of credit to any the Borrower Party Related Parties and otherwise act with respect thereto freely and without accountability in the same manner as if this Agreement and the transactions contemplated hereby were not in effect.
