Common use of OTHER CARDIAC-RELATED DEVICES Clause in Contracts

OTHER CARDIAC-RELATED DEVICES. Prior to entering into any contract with any third party with regard to the purchase, sale or distribution in the Territory of Other Cardiac-Related Devices other than for research or clinical testing of such Other Cardiac-Related Devices, each Party agrees to discuss in good faith with the other the inclusion of Other Cardiac-Related Devices under this Agreement, subject to mutually agreeable terms. Nothing in this Section 2.4 shall create an obligation between the Parties to agree to include Other Cardiac-Related Devices and any obligation to include Other Cardiac-Related Devices will arise only as and to the extent that an agreement is reached between the Parties in writing.
