Common use of Other Casualty Loss Clause in Contracts

Other Casualty Loss. In all cases where the Leased Premises is damaged in whole or in part by fire or other casualty, Landlord shall repair the damage with reasonable dispatch, and if the damage has rendered the Leased Premises untenantable, in whole or in part, there shall be an apportionment of the rent until the damage has been repaired except as modified by Tenant's obligation to insure against rent loss (see page 5 - Insurance). In determining what constitutes reasonable dispatch, consideration shall be given to delays caused by strikes, adjustment of insurance, and other causes beyond Landlord's control. All insurance proceeds paid by reason of any damage or loss hereinabove described shall be paid to Landlord to be used by Landlord for the purposes hereinabove set forth.
