Common use of Other Change in Control Agreement Clause in Contracts

Other Change in Control Agreement. Notwithstanding anything herein to the contrary, if the Executive is a party to a Change of Control Agreement with the Company and such agreement results in the payment of benefits to the Executive as the result of a change in control, then the Executive shall receive no compensation hereunder other than the Retention Payment and Restricted Stock Units, subject to the terms and conditions herein.

Other Change in Control Agreement. Notwithstanding anything herein to the contrary, if the Executive is a party to a Hologic Change of Control Agreement with the Company and such agreement results in the payment of benefits to the Executive as the result of a change in controlcontrol (as defined therein), then the Executive shall receive no compensation hereunder other than accrued salary and bonus and the Retention Payment and Restricted Stock Units, subject to the terms and conditions herein.

Other Change in Control Agreement.
