Common use of Other Company Loans Clause in Contracts

Other Company Loans. Except as provided under Section 4.4.3, no Member, as such, will be required to lend any funds to the Company. Any Member or Affiliate of a Member may, subject to the provisions of this Section 4.4.4, Section 5.2.6 and any other senior loan, credit or financing agreement of the Company, lend or advance money to the Company or a subsidiary, make loans to the Company or a subsidiary (“Company Loans”) or guaranty any loans made to the Company or a subsidiary, and any such Company Loan or guaranty by a Member or an Affiliate of a Member will not be considered to be a Capital Contribution.
