Other courses of action. If the mediation referred to in clause 11.4 or the expert determination required or agreed under clause 11.5 has not resulted in resolution of the dispute, any Party may take whatever course of action it deems appropriate (including commencing and prosecuting any proceedings in any court of competent jurisdiction) for the purpose of resolving the dispute.
