Other Financing Facilities Clause Samples
Other Financing Facilities. No defaults or events of default exist under any Other Financing Facilities. No additional Other Financing Facilities have been entered into on or after the Restatement Closing Date without the prior consent of Buyer (not to be unreasonably withheld).
Other Financing Facilities. Except for the financing facilities described on Schedule VIII or as described in a prior written notice from the Sellers to each Group Agent, no Seller will sell, pledge or otherwise finance any Mortgage Loans other than under the Repurchase Agreement.
Other Financing Facilities. No defaults or events of default exist under any Other Financing Facilities.
Other Financing Facilities. All credit facilities, repurchase facilities or substantially similar facilities of Seller which are presently in effect are listed on Schedule 2 hereto, which schedule shall be updated by Seller as required to reflect each Other Financing Facility to which Seller becomes a party. No Other Events of Default exist under any of the Other Financing Facilities. Seller shall give Buyer prior notification if any amendment to any financial covenant (with respect to Seller) in any Other Financing Facility increases the obligations or requirements of any Seller or any Affiliate thereof thereunder, and such changed financial covenant shall, with no further action of Seller or Buyer, automatically become a part hereof and be incorporated herein upon the effectiveness of such amendment in the Other Financing Facility.
Other Financing Facilities. Other than the financing facilities described on Schedule VIII or as described in a written notice from the Sellers to each Group Agent, no Seller has entered into any agreements pursuant to which it finances any Mortgage Loans.
