Common use of Other Indemnity Rules Clause in Contracts

Other Indemnity Rules. If any Losses arise, directly or indirectly, in whole or in part, out of the joint or concurrent negligence of the Parties, each Party’s liability therefor shall be limited to such Party’s proportionate degree of fault. Payments required to be paid by Operator to Owner under this Article XII or due to breach of this Agreement shall not constitute an Operating Expense or otherwise be reimbursable to Operator from Owner.
