Common use of Other Outgoings and Expenses Clause in Contracts

Other Outgoings and Expenses. (a) The Owner shall be responsible for: (i) all costs and expenses in relation to maintenance and repairs of inherent defects of a capital and non-recurring nature in the Property (except in the case where want of repair or maintenance is caused by the act, default, misuse, negligence or omission of KWHK and/or any identifiable third party, in which case such costs shall be borne absolutely by such party); and (ii) the premium of property all risks insurance of the Property (“Property Insurance”) (collectively, “Owner’s Other Outgoings and Expenses”). (b) Without prejudice to Clauses 4.8(a), 4.8(b) and 4.8(c), as the Owner’s leasing management agent, KWHK shall use reasonable efforts to procure the lessee(s), tenant(s) and licensee(s) of any part(s) of the Property to pay the Government rent and rates, management fees, fitting out costs, utility expenses and expenses for the upkeep and maintenance of non-structural parts of the space which such lessee(s), tenant(s) or licensee(s) occupy.
