Other Property Purchase Agreements. Section 9.1.17 of the Agreement is hereby amended to state that the obligation of Buyer to purchase the Property pursuant to the Agreement shall, at the option of Buyer, be subject to the fulfillment of the condition that Buyer and the Other Sellers under only the Tranche 1 PSAs concurrently close on the purchase and sale of each of the Tranche 1 Properties pursuant to the terms and conditions of the Tranche 1 Property PSAs.
