Other Remedies of Trustee. During the continuance of any Servicer Termination Event or Special Servicer Termination Event, as the case may be, or so long as such Servicer Termination Event or Special Servicer Termination Event shall not have been remedied, the Trustee, in addition to the rights specified in Section 7.1, shall have the right, in its own name as trustee of an express trust, to take all actions now or hereafter existing at law, in equity or by statute to enforce its rights and remedies and to protect the interests, and enforce the rights and remedies, of the Trust Interest Owners and the Companion Loan Holders (including the institution and prosecution of all judicial, administrative and other proceedings and the filing of proofs of claim and debt in connection therewith). In such event, the legal fees, expenses and costs of such action and any liability resulting therefrom shall be expenses, costs and liabilities of the Trust, and the Trustee shall be entitled to be reimbursed therefor pursuant to Section 3.4(c) from the Collection Account. Except as otherwise expressly provided in this Agreement, no remedy provided for by this Agreement shall be exclusive of any other remedy, and each and every remedy shall be cumulative and in addition to any other remedy and no delay or omission to exercise any right or remedy shall impair any such right or remedy or shall be deemed to be a waiver of any Servicer Termination Event or Special Servicer Termination Event.

Other Remedies of Trustee. Except as otherwise expressly provided in this Agreement, no remedy provided for by this Agreement shall be exclusive of any other remedy, and each and every remedy shall be cumulative and in addition to any other remedy and no delay or omission to exercise any right or remedy shall impair any such right or remedy or shall be deemed to be a waiver of any Servicer Termination Event or Special Servicer Termination Event.

Except as otherwise expressly provided in this Agreement, no remedy provided for by this Agreement shall be exclusive of any other remedy, and each and every remedy shall be cumulative and in addition to any other remedy and no delay or omission to exercise any right or remedy shall impair any such right or remedy or shall be deemed to be a waiver of any Servicer Termination Event of Default or Special Servicer Termination EventEvent of Default, if applicable.

Except as otherwise expressly provided in this Agreement, no remedy provided for by this Agreement shall be exclusive of any other remedy, and each and every remedy shall be cumulative and in addition to any other remedy and no delay or omission to exercise any right or remedy shall impair any such right or remedy or shall be deemed to be a waiver of any Servicer Termination Event or Special Servicer Termination Event.

During the continuance of any Servicer Event of Default, Termination Event or a Special Servicer Event of Default, so long as such Servicer Event of Default, Termination Event or Special Servicer Termination EventEvent of Default, as the case may beif applicable, or so long as such Servicer Termination Event or Special Servicer Termination Event shall not have been remedied, the Trustee, in addition to the rights specified in Section 7.17.01, shall have the right, in its own name as trustee of an express trust, to take all actions now or hereafter existing at law, in equity or by statute to enforce its rights and remedies and to protect the interests, and enforce the rights and remedies, of the Trust Interest Owners and the Companion Loan Holders Certificateholders (including the institution and prosecution of all judicial, administrative and other proceedings and the filing of proofs of claim and debt in connection therewith). In such event, the legal fees, expenses and costs of such action and any liability resulting therefrom shall be expenses, costs and liabilities of the TrustTrust Fund, and the Trustee shall be entitled to be reimbursed therefor pursuant to Section 3.4(c) from the Collection AccountAccount as provided in Section 3.06. In such event, the legal fees, expenses and costs of such action and any liability resulting therefrom shall be expenses, costs and liabilities of the TrustTrust Fund, and the Trustee shall be entitled to be reimbursed therefor pursuant to Section 3.4(c) from the Collection AccountAccount as provided in Section 3.06. Other Remedies of Trustee. In such event, the legal fees, expenses and costs of such action and any liability resulting therefrom therefrom, to the extent that any such fees, expenses and costs were not recovered by the Trustee as a result of such action, shall be expenses, costs and liabilities of the TrustTrust Fund, and the Trustee shall be entitled to be reimbursed therefor pursuant to Section 3.4(c) from the Collection AccountAccount as provided in Section 4.01(d). Except as otherwise expressly provided in 113 this Agreement, no remedy provided for by this Agreement shall be exclusive of any other remedy, and each and every remedy shall be cumulative and in addition to any other remedy and no delay or omission to exercise any right or remedy shall impair any such right or remedy or shall be deemed to be a waiver of any Servicer Termination Event or Special Servicer Termination Eventof Default.

Except as otherwise expressly provided in this Agreement, no remedy provided for by this Agreement shall be exclusive of any other remedy, and each and every remedy shall be cumulative and in addition to any other remedy and no delay or omission to exercise any right or remedy shall impair any such right or remedy or shall be deemed to be a waiver of any Servicer Termination Event or Special Servicer Termination Event.

Other Remedies of Trustee. During the continuance of any Servicer Termination Event of Default or a Special Servicer Termination EventEvent of Default when the Servicer is also serving as Special Servicer, as the case may be, or so long as such Servicer Termination Event of Default or Special Servicer Termination Event of Default, if applicable, shall not have been remedied, the Trustee, in addition to the rights specified in Section 7.17.01, shall have the right, in its own name as trustee of an express trust, to take all actions now or hereafter existing at law, in equity or by statute to enforce its rights and remedies and to protect the interests, and enforce the rights and remedies, of the Trust Interest Owners and the Companion Loan Holders Certificateholders (including the institution and prosecution of all judicial, administrative and other proceedings and the filing of proofs of claim and debt in connection therewith). In such event, the legal fees, expenses and costs of such action and any liability resulting therefrom shall be expenses, costs and liabilities of the TrustTrust Fund, and the Trustee shall be entitled to be reimbursed therefor pursuant to Section 3.4(c) from the Collection AccountAccount as provided in Section 3.06.
