As of the date of termination of the Executive’s employment with the Company, the Executive’s rights to any particular employee benefit will be governed by applicable law and the terms and provisions of the Company’s various employee benefit plans and arrangements. The date of termination of the Executive’s employment with the Company shall be used in determining benefits under all Company employee benefit plans.
