Other Rights Not Affected. A termination of employment by the Surviving Entity or by the Executive will not affect any rights that the Executive or the Executive’s dependents may have pursuant to any agreement, policy, plan, program or arrangement of the Surviving Entity providing Employee Benefits, which rights shall be governed by the terms thereof.
