Other Transactions Permitted. Subject to SECTION 4.7(a) and applicable securities laws, the Company acknowledges and agrees that nothing in this SECTION 4.7 or elsewhere in any Transaction Document prohibits any Purchaser from, and each Purchaser is permitted to, engage, directly or indirectly, in hedging transactions involving the Securities and the Common Stock (including by way of short sales, purchases and sales of options, swap transactions and synthetic transactions) at any time.

Other Transactions Permitted. Subject to SECTION 4.7(aSection 4.9(a) and applicable securities laws, the Company acknowledges and agrees that nothing in this SECTION 4.7 Section 4.9 or elsewhere in any Transaction Document prohibits any Purchaser from, and each Purchaser is permitted to, engage, directly or indirectly, in hedging transactions involving the Securities and the Common Stock (including including, without limitation, by way of short sales, purchases and sales of options, swap transactions and synthetic transactions) at any time.
