OTHER UPGRADES. Nothing in this Agreement is intended to prohibit either Sharer or Xxxxxx from implementing new transmission systems or new technical standards for its station using the Shared Channel, unless any such new system or standard could reasonably be expected to: (i) adversely affect the other party’s station or the Shared Channel or (ii) require the other party to make a material change in its operations, in which event the other party’s consent shall be required prior to implementing such new system or standard.
OTHER UPGRADES. In addition to the ATSC 3.0 Upgrade, Sharer, in its sole discretion and at its expense, may at any time implement any new transmission systems or new technical standards for Sharer’s Station or the Shared Channel.
OTHER UPGRADES. Specific requirements as applicable to the detailed engineering design drawings are to be inserted.
OTHER UPGRADES. Not applicable.
OTHER UPGRADES. The Owner AGREES to arrange for the conveyance and construction of that portion of St Xxxxxx Road that intersects with Xxxxxx Street, beyond the limit of the plan of subdivision, as noted in Schedule B, subsection 9. All costs associated with the conveyance and construction shall be the responsibility of the Owner.
OTHER UPGRADES. The Owner AGREES to pay $70,000 to the City, at the time of issuance of first building permit, to support the design and installation of the traffic signals at the intersection of Cedartree Lane and East Street/CKL Road 36.
OTHER UPGRADES. The Owner COVENANTS AND AGREES to provide for the design and construction of Xxxxx Street to the satisfaction of the Engineering and Corporate Assets Department of the City, as shown in Schedule “A-1”and Schedule “D”.
OTHER UPGRADES. The Owner is required to construct, entirely at their expense, the roadway and municipal services on Streets B, C and D, abutting/adjacent to the subdivision, necessary to provide access and services to the proposed subdivision. The City agrees that the completion of the aforementioned road and servicing work is not a precondition to the Owner obtaining Building Permits from the City for the construction of the dwellings within the Subdivision and that the City shall issue Building Permits to the Owner for such dwellings notwithstanding that there may be incomplete road and servicing work at the time of any Building Permit issuance. Provided however that the Owner shall not be entitled to receive occupancy clearance from the City for any dwelling constructed as aforesaid until all requisite road and servicing work as hereinbefore contemplated is completed to the satisfaction of the City. The Owner further agrees not to impose Section 11.(3) of the Building Code Act, with respect to the occupancy inspections stated herein.
OTHER UPGRADES. The Town shall reline the Bull Run Interceptor (Xxxx’s Farm Outfall) with cured in-place pipe lining from Mackay Road to Guilford College Road on a schedule suitable to the Town in its sole discretion.
