Our Liability for Failure to Process an Electronic Funds Transfer. If we do not complete an Electronic Funds Transfer initiated through Mobile Banking or Online Banking (including a Xxxx Pay transfer that is an Electronic Funds Transfer) on time, or in the correct amount according to this Agreement, we will be liable for your losses or damages. However, there are exceptions. For example, we will NOT be liable if: (1) There is not enough money in an Account to make the transfer, or the funds are not available to make the transfer due to legal process or other restrictions; (2) The transfer would cause the Account to exceed the credit limit on the overdraft line of credit (if any) for the Account; (3)A User’s computer, Internet service, Mobile Device, or other equipment is not working properly;
