Common use of Over Provision Clause in Contracts

Over Provision. 7.1 If any provision contained in the accounts of the Company for periods up to 31 August 1995 shall be found to be an over-provision or excessive ("Over-provision") then the amount of the Over-provision shall be set off against any payment due or which may become due from the Covenantor under this Deed. 7.2 If the Company or the Purchaser shall discover that there has been an Over-provision the Purchaser shall or shall procure that the Company shall forthwith give full details thereof to the Covenantor and the Purchaser shall or shall procure that the Company shall supply to the Covenantor such information as he may reasonably require to verify the amount of the Over-provision.
