Overage. At any time during the subscription term set forth in an Order, if Customer usage exceeds its License Level (“Overage”), Customer will correct the Overage by purchasing additional licenses within thirty (30) days of the Overage. If Customer does not purchase licenses for the Overage within such thirty (30) day period, Flexera may suspend Customer’s use of the SaaS by providing fifteen (15) days prior notice. Customer agrees (i) that Flexera may access to view Customer’s instance(s) of the SaaS and (ii) to provide Flexera with all information reasonably required for the purpose of verifying Customer’s compliance with the License Level, which may be in the form of a formal certification.
Overage. The Tenant covenants to pay overage in accordance with the Overage Provisions of Schedule 3 and the parties agree to comply with their obligations thereunder.
Overage. If your Sales Order indicates that you acquired transaction licenses of the Licensed Software and Licensor permits your use of such transaction component(s) of such licenses in excess the number of transactions that you have purchased as identified in the Sales Order (e.g. a designated number of transactions), then you will pay to Licensor overage fees for such excess use in the amount provided in the Sales Order. If you fail to timely pay any overage fees to Licensor, Licensor will have the right to terminate this License Agreement.
Overage. In the event that the Further Planning Permission consents a different Net Internal Area (whether greater or lower) to that authorised by the Initial Planning Permission the Overage Calculation Sum shall be calculated in accordance with the provisions of paragraph 2.2:
Overage. Lacework reserves the right to monitor Customer’s use of the Service. Any use of the Service by Customer in excess of the licenses granted in the applicable Order (“Overage”) is subject to billing in arrears by Lacework or a Reseller in accordance with Lacework’s Usage Policy. Subject to Section 14.1 below, Lacework may update the Usage Policy from time to time.
Overage. “Overage” means excess Garbage and Organic Waste (i) placed inside a 364 Container that prevents the lid on the Container from being completely closed (i.e., lid remains open 365 greater than 45-degrees) or excess materials placed on top of or around a Container and (ii) could 366 potentially result in excess materials spilling/dislodging during collection activity by Contractor’s Collection 367 Vehicles.
Overage. Any overage in time will be billed at the rate of $ 5 /hr. Payment for any overage in time must be paid before additional hours will be provided. If the Event ends earlier than expected, no refund will be given.
Overage. If the Report shows the Ordering Activity has exceeded the Authorized Use Limitation at any time during a month, such Report shall constitute the basis for a claim to the relevant Contracting Officer pursuant to the Contract Disputes Act and FAR 52.233-1. In no event may the Perpetual License or Subscription License quantity be lowered below the original number ordered.”
Overage. In the event that during any month Service Provider has exceeded the Subscription Quantity, Service Provider’s report shall be deemed a request for an order for such additional Subscription Quantity that are required to remain in compliance with the Agreement and Service Provider shall execute an Order Form for such additional Subscription Quantity. Such additional Subscription Licenses shall remain in effect and billed at the rates set forth in the initial Order Form through to the end of the then current Subscription Term. During the Subscription Term, the Subscription Quantity may not be lowered below the number ordered in the initial Order Form. . Failure to comply with this Section 3 shall be deemed a material breach of the Agreement.
Overage. If your use of the Services exceeds the capacities set forth on the Order Form or otherwise requires the payment of additional fees (per the terms of the Order Form or this Agreement), Radar will invoice you for such usage and you agree to pay the additional fees in the manner provided herein.
