Common use of Overcharges and Unauthorized Charges Clause in Contracts

Overcharges and Unauthorized Charges. If applicable, in the event an audit is conducted in accordance with this Section which discloses overcharges or unauthorized charges to SBBC by CITY in excess of two percent (2%) of the total xxxxxxxx under this Agreement, the actual cost of SBBC’s audit shall be paid by CITY. If the audit discloses xxxxxxxx or charges to which CITY is not contractually entitled, CITY shall pay said sum to SBBC within twenty (20) days of receipt of written demand under otherwise agreed to in writing by both parties.
