Common use of Owner Events of Default Clause in Contracts

Owner Events of Default. The following shall be considered "Owner Events of Default": 12.3.1 if the Work is stopped for a period of one hundred eighty (180) Days through no act or fault of the Design/Builder for any of the following reasons: 12.3.1.1 issuance of an order of a court or other public authority having 12.3.1.2 an act of government, such as a declaration of national emergency, making material unavailable; 12.3.2 if the Work is stopped for a period of thirty (30) Days through no act or fault of the Design/Builder because the Owner has not made payment of undisputed amounts set forth in an Application for Payment within the time stated in the Contract Documents.
