An Owner / Operator Agreement clause defines the relationship and responsibilities between the owner of an asset, such as a vehicle or equipment, and the individual or entity operating it. Owner / Operator Agreements. (a) The Company shall provide the local Union office with a copy of each Owner Operator Agreement, signed by the Company and the Owner Operator.
(b) It shall be the responsibility of the Company, when contracting with a new Owner Operator, to have him/her sign a Union membership card and forward it to the Local Union Office within fourteen (14) calendar days of their being hired.
(c) The Provincial Unit Chairperson and/or Designate will be present during all of the Owner Operator Business Agreement negotiations, sign as a witness to the negotiation and be given a copy of the signed Agreement.
(d) The Provincial Unit Chairperson and the Regional Director, or their respective designates, will have the only signing authority for all Owner Operator Business Agreements. The Business Agreement shall be signed for the duration of the Collective Agreement.
(e) It is agreed between both parties that during the negotiations of the Business Agreements, Schedules A & B and Appendix C shall be included as one document. This process shall also include the signing of Business Agreements with new Owner Operators. Owner Operators' Business Agreements, Rules and Guidelines are shown in National Appendix "A" which forms part of the National Collective Agreement.
(f) It shall be in direct violation of the Collective Agreement for an Owner Operator to allow his vehicle to be driven by another Driver for the purpose of evading the Collective Agreement.
Owner / Operator Agreements. Schedule 3.11.7 contains a list of all agreements between management and supervisory personnel of the Restaurants and Seller and/or Eateries. Except as set forth in Schedule 3.11.7, no Person has any claim, right or any agreement to purchase, acquire or receive any ownership interest in Seller or the Assets or receive any income from the Restaurants or Seller.

The parties further agree that (i) notwithstanding anything to the contrary contained herein, neither Buyer nor any of its designated Affiliates shall have any obligation or liability to any Owner/Operator under any Owner/Operator Agreement, or otherwise for any obligation or liability accruing prior to the Closing Date except to the extent of the credit received pursuant to the Owner/Operator Agreement in accordance with Section 2.4.6; (ii) the transactions contemplated by this Section 2.1.7 are expressly conditioned upon the Closing of the transactions contemplated by this Agreement; and (iii) the transactions contemplated by this Section 2.1.7 shall not affect the payment or the calculation of the Purchase Price, as contemplated in Section 2.2, except for the pro-rations as set forth in Section 2.4.6.
