Common use of Owner's Approval of Subcontracts Clause in Contracts

Owner's Approval of Subcontracts. Unless otherwise stated in the Contract Documents or the bidding requirements, the Contractor, as soon as practicable after award of the Contract, shall furnish in writing to the Project Manager the names of persons or entities (including those who are to furnish materials or equipment fabricated to a special design) proposed for each principal portion of the Work. Contractor shall recommend award of each Subcontract to the bidder whose bid is responsive to the bid invitation, and whose bid represents the best value to the Owner, taking into account price, terms and conditions, financial capability to perform the Work, qualifications and history of performance, safety and responsiveness. The acceptance or approval by Owner of any such subcontract award recommendation shall not be construed as creating any contractual relationship between any Subcontractor and Owner, nor shall it relieve Contractor of any obligations under this Agreement.
