Common use of OWNERS AUTHORITY Clause in Contracts

OWNERS AUTHORITY. Owner is the sole fee simple owner of the Property including the subsurface estate thereof, and has the unrestricted right and authority to execute this Agreement and to grant to Tenant the rights granted hereunder. Each person signing this Agreement on behalf of Owner is authorized to do so. Upon execution by all Parties hereto, this Agreement shall constitute a valid and binding agreement enforceable against Owner in accordance with its terms. Each person/entity comprising Owner, as listed in the preamble to this Agreement, owns the fractional interest in the Property set forth below: Fractional Ownership: 100 %
