Ownership of Agreement Material and Commonwealth Material. 40.1 Unless otherwise set out in the Records Management Instructions, as between the Department and the Provider (but without affecting the position between the Provider and a third party) ownership of the physical Material constituting: Commonwealth Material; and Agreement Material, vests at all times in the Department.
