Common use of Ownership of the Equipment and the Operational Permit Clause in Contracts

Ownership of the Equipment and the Operational Permit. Each item of the Equipment shall become the property of the Employer upon the issue or deemed issue (as the case may be) of the Taking-Over Certificate by the Engineer in accordance with sub-clause 10.1 [Taking Over of the Works and Sections]. Immediately after the Taking-Over Certificate has been issued, or is deemed to have been issued in accordance with sub-clause 10.1 [Taking Over of the Works and Sections] the Contractor shall take all actions aimed at obtaining final Operational Permits with respect to all Equipment. The Works shall not be deemed completed within the Time for Completion for the Works unless the Contractor obtains all Operational Permits required under the Contract.
