PACKING, MARKING, AND SHIPPING a. No charge shall be made by Seller for packaging or storage unless specified on the face of this AGREEMENT.
b. Unless otherwise specified, all Products shall be packaged, marked, and otherwise prepared in accordance with the Procurement Specifications, Technical Data Package (TDP), applicable laws and regulations, and good commercial practices.
c. To the extent it may be lawful to do so; Seller shall use commercially reasonable efforts to obtain fair and reasonable shipping rates.
d. Seller shall mark containers or packages with necessary handling, and loading instructions, shipping information, Buyer’s Purchase Order number, item and shipment date, and names and addresses of Seller and Buyer. An itemized packing list shall accompany each shipment. Bills of Lading shall include Buyer’s Purchase Order number.
e. Failure by the Seller to provide any required samples or documentation prior to or with the shipment of Products as stated in this AGREEMENT or in the referenced Quality Assurance Provisions, if any, may result in the assessment by the Buyer of a penalty for each occurrence. Buyer shall have the right to set off any such penalty against any amount owed Seller by Buyer under this AGREEMENT or any other agreements between the parties.
PACKING, MARKING, AND SHIPPING. Shipments shall be routed in accordance with MBV's instructions, and unless otherwise specified by MBV in writing in advance, shipments shall be delivered Delivery Duty Paid (“DDP”) (Incoterms 2010), MBV's dock, 0000 Xxxxxxxx Xxxxxxxx Xxxxxxx, Xxxxxx, Xxxxx Xxxxxxxx 00000. Supplier agrees to reimburse MBV for all expenses incurred by MBV as a result of improper packing, marking or routing. MBV's purchase order number and part number and Supplier's shipment identification number shall appear on each package and bill of lading. Items for two or more of MBV's locations shall be shipped in separate packages for the different locations. Shipments in excess of those authorized may be returned to Supplier, and Supplier shall pay the transportation charges both ways for such shipments. MBV may at any time and from time to time change shipping schedules previously furnished to Supplier, or direct temporary suspension of scheduled shipments. MBV's count will be accepted as final on all shipments. Unless otherwise expressly agreed to in writing by MBV, no charge shall be made by Supplier for containers, crating, packing, boxing, bundling, dunnage, drayage, or storage.

Seller, at its own cost and expense, shall pack and ship all work, materials and goods in accordance with the requirements of Buyer and the carrier transporting the same. Seller shall mark each package in accordance with the instructions of Buyer and the carrier transporting the same. Seller will reimburse Buyer for costs incurred as a result of improper packing, marking, routing or shipping.
PACKING, MARKING, AND SHIPPING. All Products shall be properly packaged to prevent damage or deterioration and to obtain the lowest transportation rates. PACCAR will pay no charge for packing, shipping, drayage or storage or for preparation, crating, dunnage or other materials unless separately stated on this purchase order. Each packing slip, bill of lading, invoice, container, tag and correspondence shall bear the applicable purchase order number (or the release order number applicable to each shipment if this is a blanket purchase order) and the location of the facility to which Products are to be shipped. A waterproof master packing slip shall accompany each shipment and shall be included in one of the packages marked "Packing Slip Inside" or, in the case of a carload shipment, be conspicuously displayed on the inside of the freight car.
PACKING, MARKING, AND SHIPPING. All goods shall be suitably packed using best commercial practices, marked and shipped in a manner to adequately protect the goods in shipment and to secure lowest transportation costs unless otherwise specified by Buyer in this Order. Packing slips shall be placed in each shipment and the Order number shall be referenced on the packing slip. No packing or related charges shall be allowed except where specifically agreed and a line item is provided in this Order for such charges. Seller shall provide Buyer prior written notice if it requires Buyer to return any packaging material, and the return of any such packaging material shall be made at Seller’s expense.
PACKING, MARKING, AND SHIPPING. 2.1 All Goods shall be packaged, marked and prepared for shipment in the manner which is specified in the Order, provided that to the extent no specific manner is set forth in the Order, then: (a) in accordance with good commercial practice, (b) acceptable to common carriers for shipment at the lowest rate for the particular Goods and in accordance with applicable UCC regulations, (c) in accordance with the current edition of PTI’s packaging standards, and (d) adequate to ensure safe arrival of Goods at the named destination. Country of origin shall be documented, including code section references for U.S. goods, and appropriate labels.
2.2 Any transportation charges shall be prepaid by Supplier and any such charges for which it is entitled to reimbursement shall be added to Supplier’s invoice as a separate item and the receipted freight xxxx shall be attached thereto. All Goods shall be shipped F.O.B. point of origin and in the manner set forth on the Order.
2.3 No charge shall be made by Supplier for containers, crating, boxing, bundling, dunnage, drayage, storage or insurance, except as expressly provided in the Order.
2.4 In the event of any improper packing, marking, shipping or routing and/or any failure to observe the conditions of this Section, Supplier shall reimburse PTI for all expenses arising therefrom and shall pay any resulting additional freight, cartage or other costs incurred, directly or indirectly.
2.5 Except as otherwise required, all containers to be returned to Supplier shall be shipped on a no-charge basis with Supplier’s name and address and demand for return clearly marked thereon.
2.6 Each shipment must include packing slips and bills of lading bearing the applicable purchase order number and the location of the plant to which supplies are to be shipped.
2.7 All invoices shall contain the following assurance: “Supplier represents that it has complied with the Fair Labor Standards Act of 1938, as amended, in supplying or performing the services covered by this invoice.”
PACKING, MARKING, AND SHIPPING. The Supplier shall follow all applicable transportation regulations and good commercial practice for protection to preserve, package and contain shipments in order to prevent deterioration and damage during shipping. For hazardous materials, the Supplier shall follow applicable Federal, state and local laws and regulations for the packaging, labeling, transportation and shipping of such items. XXXXX specific instructions for packaging and shipping shall be flowed down in the purchase order as needed. The use of newsprint for packaging is prohibited. Damage resulting from improper packing or shipping will be charged to the Supplier.
