Common use of Paragon Returns Clause in Contracts

Paragon Returns. With respect to any Separate Return Paragon is obligated to file pursuant to Section 3.2, Paragon shall not take (and shall cause the members of the Paragon Group not to take) any position that it knows, or reasonably should know, would adversely affect any member of the Noble Group. Furthermore, with respect to any such Separate Return, Paragon shall not take (and shall cause the members of the Paragon Group not to take) any position that it knows, or reasonably should know, is inconsistent with the past practice of the Noble Group or the Paragon Group.

Paragon Returns. With respect to any Separate Return Paragon is obligated to file pursuant to Section 3.2Article III, Paragon shall not take (and shall cause the members of the Paragon Group not to take) any position that it knows, or reasonably should know, would adversely affect any member of the Noble Group. Furthermore, with respect to any such Separate Return, Paragon shall not take (and shall cause the members of the Paragon Group not to take) any position Exhibit B Protected by FRE 408 that it knows, or reasonably should know, is inconsistent with the past practice of the Noble Group or the Paragon Group.
