Common use of Parental or Sponsor’s Guaranty Clause in Contracts

Parental or Sponsor’s Guaranty. The Landlord requires, as a condition of this lease, a binding Continuing Parental or Sponsor Guaranty (the “Guaranty”), which Guaranty constitutes inducement for the granting of this Lease by Landlord. Landlord reserves the right to not enter into and/or to cancel this Lease in the event such Guaranty is not fully completed and submitted to the leasing staff at the time of application. Tenant understands that the Guaranty must be obtained directly from the parent or sponsor and that Landlord reserves all rights both civil and criminal, for any false execution or forgery of the Guaranty. Tenant and Guarantor acknowledge that this Lease is for an essential necessity of Tenant, and that Tenant and Guarantor shall be fully bound by all of the terms and conditions hereof irrespective of Tenant’s age or legal status. The execution of the Guaranty constitutes an additional insurance to Landlord of the performance of the covenants of this lease and shall not be construed as a release of Tenant’s responsibilities and obligations hereunder. Tenant may not include themselves or another UMD student as a Guarantor for the lease. Parents are not automatically considered a Guarantor for the lease, and therefor do not share the same right of access to information for said lease if they are not a Guarantor. Only financial information and information concerning damages will be shared with Guarantor without prior Tenant approval.

Parental or Sponsor’s Guaranty. The Landlord requireswill require a Cosigner/Guarantor Agreement at the time of application, as a condition of this lease, a binding Continuing Parental if the applicant has an unsatisfactory or Sponsor Guaranty (the “Guaranty”), which Guaranty constitutes inducement for the granting of this Lease by Landlordinsufficient credit history. Landlord reserves the right to not enter into and/or to cancel this Lease at any time in the event such Guaranty is not fully completed executed, notarized, and submitted returned to the leasing staff at Landlord’s Agent (BELLA PROPERTIES) within fifteen (15) days from the time date of applicationexecution of this Lease by Resident. Tenant Resident understands that the Guaranty must be obtained directly from the parent or sponsor and that the Landlord reserves all rights the right, both civil and criminal, for any false execution or forgery of the Guaranty. Tenant and Guarantor acknowledge Resident acknowledges that this Lease Guaranty is for an essential necessity of TenantResident, and that Tenant and Guarantor the Resident shall be fully bound by all of the terms and conditions hereof irrespective of Tenant’s Resident's age or legal status. The execution of the Guaranty constitutes an additional insurance to Landlord of the performance of the covenants of this Lease and any future lease extension, renewal or transfer and shall not be construed as a release of Tenant’s Resident's responsibilities and obligations hereunder. Tenant Resident understands that lack of the Cosigner/Guarantor Agreement does not release Resident from duties and financial responsibilities under this Lease agreement, unless Landlord cancels Lease agreement. Resident also understands that Landlord may refuse occupancy if Cosigner/Guarantor Agreement is not include themselves or another UMD student as a Guarantor received prior to move in and that Resident will remain liable for the lease. Parents are not automatically considered a Guarantor for the lease, and therefor do not share the same right of access to information for said lease if they are not a Guarantor. Only financial information and information concerning damages will be shared with Guarantor without prior Tenant approvalall monies due.

Parental or Sponsor Guaranty constitutes inducement will remain in effect for the granting duration of time Resident occupies the Premises. Resident understands that the Landlord is relying upon the Resident’s execution of this Lease by Landlordin making lease space decisions and that it will remove the lease space from its inventory of available lease space upon signing. Resident further acknowledges, understands and agrees that he or she has been advised that the Landlord reserves will, nonetheless, require that a binding Parental or Sponsor Guaranty be executed if the right to Resident cannot enter into and/or to cancel this Lease in prove monthly income of two times the event such Guaranty is not fully completed and submitted to the leasing staff at the time of applicationmonthly rent amount. Tenant Resident also understands that the a Parental or Sponsor Guaranty must be obtained directly from the parent or and sponsor and that the Landlord reserves the right to exercise all rights available remedies, both civil and criminal, for any false execution falsification or forgery of such guaranty, the Guarantyguaranty constituting an essential inducement for the grant of the Lease by Landlord. Tenant Notwithstanding the foregoing, Resident acknowledges, understands and Guarantor acknowledge that this agrees: • The Lease is fully binding regardless of failure to submit a Parental or Sponsor Guaranty; and • Landlord reserves the right to exercise all available remedies for an essential necessity Resident’s failure to provide and to maintain a Parental or Sponsor Guaranty, including, but not limited to, eviction (without waiver of Tenantall other rights, and that Tenant and Guarantor shall be fully bound by all including collection of rent due under the terms and conditions hereof irrespective of Tenant’s age or legal statusLease for its full term). The execution of the Guaranty constitutes an additional insurance to Landlord of the performance of the covenants of this lease and shall not be construed as a release of Tenant’s responsibilities and obligations hereunder. Tenant may not include themselves or another UMD student as a Guarantor for the lease.
