Common use of Partial Damage or Destruction Clause in Contracts

Partial Damage or Destruction. If the Premises or the Building should be damaged by any peril covered by the insurance to be provided by Landlord under Paragraph 9A above and, in Landlord's estimation, rebuilding or repairs can be substantially completed within one hundred eighty (180) days after the date of such damage, then this Lease shall not terminate and Landlord shall substantially restore the Premises to its previous condition, except that Landlord shall not be required to rebuild, repair or replace any part of the partitions, fixtures, additions and other improvements that may have been constructed, erected or installed in or about the Premises for the benefit of, by or for Tenant.

If the Premises or the Building should be damaged by any peril perils covered by the insurance to be provided by Landlord under Paragraph 9A above and, in Landlord's estimation, rebuilding or repairs can be substantially completed within one hundred eighty fifty (180150) days after the date of such damage, then this Lease shall not terminate and Landlord shall substantially restore the Premises to its previous condition, except that Landlord shall not be required to rebuild, repair or replace any part of the partitions, fixtures, additions and other improvements that may have been constructed, erected or installed in or about the Premises for the benefit of, of or by or for Tenant. In the event of partial damage to the Premises, rent shall xxxxx for the period of reconstruction for the portion of the Premises that cannot be occupied due to the casualty.

If the Premises or the Building should be damaged by any peril covered by the insurance to be provided by Landlord under Paragraph 9A paragraph 9.A above and, in Landlord's reasonable, good faith estimation, rebuilding or repairs can be substantially completed within one two hundred eighty seventy (180270) days after the date of such damage, then this Lease shall not terminate and Landlord shall substantially shall, with all reasonable dispatch but not longer than two hundred seventy (270) days after the date of such damage, restore the Premises to substantially its previous condition, except that Landlord shall not be required to rebuild, repair or replace any part of the partitions, fixtures, additions and other improvements that may have been constructed, erected or installed in or about the Premises for the benefit of, of or by or for Tenant after the Commencement Date. Landlord shall allow Tenant a fair diminution of rent during the time of such rebuilding or repairs to the extent the Premises are unfit for Tenant's use thereof.

If the Premises or the Building should be damaged by any peril covered by the insurance to be provided by Landlord under Paragraph 9A above and, in Landlord's estimation, rebuilding or repairs can be substantially completed within one hundred eighty (180) days after the date of such damage, then this Lease shall not terminate and Landlord shall substantially restore the Premises to its previous condition, except that Landlord shall not be required to rebuild, repair or replace any part of the partitions, fixtures, additions and other improvements that may have been constructed, erected or installed in or about the Premises after the Commencement Date of this Lease for the benefit of, by or for Tenant.

If the Premises or the Building building should be damaged by any peril covered by the insurance to be provided by Landlord under Paragraph 9A above and, in Landlord's estimation, rebuilding or repairs can be substantially completed within one hundred eighty (180) days after the date sale of such damage, then this Lease shall not terminate and Landlord shall substantially restore the Premises to its previous condition, except that Landlord shall not be required to rebuild, rebuild repair or replace any part of the partitions, fixtures, additions and other improvements that may have been constructed, erected or installed in or about the Premises for the benefit of, by or for Tenant.

If the Premises or the Building should be damaged by any peril covered by the insurance to be provided by Landlord under Paragraph 9A above and, in Landlord's ’s estimation, rebuilding or repairs can be substantially completed within one hundred eighty (180) days after the date of such damagedamage with sufficient Lease term to fully amortize such rebuilding or repairs, then this Lease shall not terminate and Landlord shall substantially restore the Premises to substantially its previous condition, except that Landlord shall not be required to rebuild, repair or replace any part of the partitions, fixtures, additions and other improvements that may have been constructed, erected or installed in or about the Premises for the benefit of, of or by or for TenantTenant (except for improvements installed by Landlord pursuant to Exhibit “B” of this Lease), and all rent shall xxxxx until the Premises are restored.
