Common use of Partial Possession Clause in Contracts

Partial Possession. City has the right to take possession of or to use any completed or partially completed part of the Work under an issued Job Order. Prior to taking possession of or using any part of JOC’s Work, City shall furnish JOC a list of items of Work remaining to be performed or corrected on those portions of the Work which City intends to take immediate possession of or use. JOC acknowledges City’s failure to list remaining Work does not relieve JOC from performing that Work. City’s possession or use of any completed or partially completed part of the Work shall not be deemed City’s acceptance of Work related to City’s possession or use of the partially completed part of the Work.
