Participation Criteria. PROVIDER hereby warrants and represents that PROVIDER, and all of PROVIDER’s employees, affiliates, subcontractors and/or independent contractors who provide Covered Services under this Agreement, including without limitation health care, utilization review, and/or administrative services currently meet, and throughout the Term of this Agreement shall continue to meet any and all applicable conditions necessary to participate in the Medicare/Medicare Advantage program, including general provisions relating to non- discrimination, sexual harassment or fraud and abuse, as well as all applicable laws pertaining to the receipt of federal funds; federal laws designed to prevent or ameliorate fraud, waste and abuse, including applicable provisions of federal criminal law, the False Claims Act (31 X.X.X. §0000 et seq.) and the anti-kickback statute (42 U.S.C. §1320a-7b(b)), 42 CFR §§422.504(h)(l), 423.505(h)(l), and the HIPAA administrative simplification rules at 45 CFR Parts 160, 162, and 164. PROVIDER hereby warrants and represents PROVIDER and all of PROVIDER’s employees, affiliates, subcontractors, and/or independent contractors are not excluded, sanctioned or barred from participation under a federal health care program as described in Sections 1128B(b) and 1128B(f) of the Social Security Act, and all employees, affiliates, subcontractors, and/or independent contractors of PROVIDER are able to provide a current National Provider Identifier number, as applicable.

Participation Criteria. ‌ The Professional Growth Option (PGO) shall be available and voluntary to non-classroom certificated employees who have successfully completed four (4) years of satisfactory summative evaluations (including year prior to entering PGO) with at least two (2) years in Sultan. Participation in and renewal of PGO Plans are contingent upon mutual agreement between the evaluator and the employee. If no agreement can be reached, the employee will be evaluated using the Summative Evaluation System. If a person transfers between schools or job assignment while working on a PGO Plan, continuation is contingent upon mutual agreement between the employee and the administrator. If an evaluator is new to a building, the evaluator is encouraged, but not required, to support the PGO Plans in the building. Extended timelines, adjusted by mutual agreement, will allow existing and new PGO participants to confer and mutually agree upon PGO participation. If an employee is denied participation in the Professional Growth Option, the evaluator shall state the reason(s) for denial on Form E – Interest to Participate. During the PGO period, the participant must continue to demonstrate satisfactory performance in the evaluative criteria required by state statutes and found in the Collective Bargaining Agreement. If the evaluator cannot verify that these criteria are being met, the employee will be removed from the PGO Plan and be placed on the Summative Evaluation System.
Participation Criteria. Practitioner acknowledges that the following is a list of specific criteria that Practitioner must satisfy to provide Services to Participants, and represents and warrants to HWHN that he/she currently satisfies and will satisfy during the term of this Agreement all of such criteria. • Practitioner must speak fluent English or have access to an interpreter. • Practitioner must follow OSHA safety standards, including an on-site fire extinguisher and first aid kit. • Practitioner must have a minimum of one year of professional experience or co-located with a mentor of the same practitioner type who is credentialed with HWHN. • Practitioner must be able to accept new patients. • Private treatment rooms must be available upon patient request. • If Practitioner practices in a home, Practitioner must have a separate treatment room, a patient restroom, and a sign documenting Practitioner’s specialty. Please check your city regulations on sign size. • If Practitioner sees patients in urgent situations, he/she must be available within 24 hours of a patient request or make arrangements with an appropriate back up practitioner. • If Chiropractor, practitioner must maintain current CPR certification. • Practitioner agrees to comply with State & Federal regulations regarding patient privacy of health related information. • Practitioner has belief in and willingness to participate in a network where medical cost control from a managed care standpoint and quality measures based on patient access and satisfaction are used as organizational values and guidelines.

A copy of the PQA Participation Criteria applicable to Provider Practice shall be available for review on a website available to the Provider Practice.
