Common use of Participation in Certain Proceedings and Decisions Clause in Contracts

Participation in Certain Proceedings and Decisions. Any Lessee Lender shall have the right to intervene and become a party, but only with respect to Lessee's involvement, in any Arbitration, litigation, condemnation or other proceeding affecting this Agreement to the extent of its security interest herein. Lessee's right to make any election or decision under this Agreement that is required or permitted to be made by Lessee with respect to the negotiation or acceptance of any Award or insurance settlement shall be subject to the prior written approval of such Lessee Lender.
