Common use of Passive War Risk Rider Clause in Contracts

Passive War Risk Rider. It is hereby agreed that, notwithstanding the provisions of the present Contract regarding passive war risks and in case of death only of the Life Assured or his/her total permanent disablement, if clearly stipulated in the (T.B. and C.), as a direct or indirect consequence of: war, warlike operations (whether war is declared or not, conventional, biological, chemical or nuclear), invasion, acts of foreign enemies, hostilities, acts of terrorism, terrorist sabotage, rebellion, mutiny, riot, civil commotion, political or civil unrest, civil war, revolution, insurrection, military or usurped power, martial law, embargo, piracy, or any act committed by any person or persons for the purpose of overthrowing a government by violent force or to influence political decision making. Terrorism (suspected or proven) shall be understood to include the consequences of hostage taking, drive-by shootings, planting of bombs, and other forms of physical violence, the Company pledges by this cover to pay the sums assured shown in the (T.B. and C.) under covers A, B, C and D if selected according to the terms and conditions of paragraph 10 to the nominated beneficiary in case of death of the Life Assured and paragraph 11 to the Contract Owner in case of total permanent disablement. Benefits would be paid if it can be proven that, at the time of suffering the loss the Life Assured was in no way directly, indirectly, proximately or remotely, actively or otherwise participating or engaging in any of such activities, nor was he/ she in the course of controlling, preventing, suppressing or in any other way dealing or attempting to deal therewith; except for any actions or steps as were reasonably necessary for the protection of himself/herself or his/her property.
