Common use of Past Due Charges Clause in Contracts

Past Due Charges. If any charges are not received from You by the due date, then at Our discretion, We may, beginning on the tenth day the charge is overdue, charge an administrative fee at 18% per annum for each occurrence. Additionally, if You are past due on any invoices or charges due and owing to Us, We may place You on support hold wherein We will stop working on Custom Change Request Tickets and You will not be allowed to enter new Custom Change Request Tickets until all fees and charges are current. In the case of an ACH payment being rejected for non-sufficient funds (“NSF”), We may attempt to process the charge again within 30 days. We may charge an additional $25.00 fee for each attempt to process the charge which will be initiated as a separate transaction from the authorized recurring payment. Furthermore, if an ACH payment is returned, We will remove the ACH payment method and require payments to be made via wire transfer or certified funds.
