Common use of Patent Filing Costs Clause in Contracts

Patent Filing Costs. All costs associated with filing, prosecuting and maintaining patent applications and patents covering each of GelTex and Genzyme's Patent Rights specific to the Field shall be deemed Development Costs; provided, however, that if the claims of any such Patent Rights include claims outside the Field, each of RenaGel LLC and the Party filing, prosecuting and maintaining such patents and patent applications shall bear one-half (1/2) of such costs.

All costs associated with filing, prosecuting and maintaining patent applications and patents covering each of GelTex Diacrin and Genzyme's Patent Rights specific to the Field shall be deemed Development Costs; provided, however, that if the claims of any such Patent Rights include claims outside the Field, each of RenaGel Diacrin/Genzyme LLC and the Party filing, prosecuting and maintaining such patents and patent applications shall bear one-half (1/2) of such costs.

All costs associated with filing, prosecuting and maintaining patent applications and patents covering each of GelTex GTC and Genzyme's Patent Rights and the Genzyme/GTC Patent Rights specific to the Field in the Territory shall be deemed Development Costs; provided, however, that if the claims of any such Patent Rights include claims outside the Field, each of RenaGel ATIII LLC and the Party filing, prosecuting and maintaining such patents and patent applications shall bear one-half (1/2) of such costscosts itself and the other half of such costs shall be deemed Development Costs.
