PAYMENT AND COLLECTION OF ASSESSMENTS. 1. Any assessment levied pursuant to this Agreement shall constitute a debt of every Signatory Handler so assessed and shall be due and payable to the Department or the Board at such times and in such a manner as the Department may prescribe. 2. In the event that a Handler becomes a Signatory Handler to the Agreement, they shall pay an annual non-refundable assessment, recommended by the Board and approved by the Department which shall be due and payable to the Department or the Board at such times and in such manner as the Department or the Board may prescribe. The level of this Signatory Handler assessment will be established in an amount to defray the necessary expenses of administering the programs and for the research, inspection, process verification and audit processes.
