Common use of Payment by Automated Means Clause in Contracts

Payment by Automated Means. (a) You may view and print an invoice for Your Account using the administrative control panel made available to You. On or about the first (1st) day of each month, NEC will apply the current monthly charges to Your automated payment method, the relevant information of which You entered on the billing information page in the administrative control panel. Payment by automated means includes any form of automated payment accepted by NEC from time to time, including credit card, debit card, direct debit or other means. (b) You must provide NEC with valid automated payment information as a condition to receive or use the Services. You are responsible for and agree to update NEC with any changes to Your billing and/or automated payment information (e.g., new or updated credit card, credit card expiration date or other payment account information). By providing NEC with the automated payment information, You authorize NEC to charge Your automated payment account for any amounts arising from or relating to the Services without further authorization from You. It is Your responsibility to keep Your automated payment information up-to-date. If charges to Your automated payment account fail, NEC will email a warning to Your Account billing contacts. (c) If NEC is unable to successfully process Your payment by automated means by the seventh (7th) calendar day of the month for which the payment is due, Your payment will be considered late and not paid in full. NEC may suspend or terminate Your Account in accordance with Section 2.3(b)(i) for failure to timely pay in full. Late payments are subject to a late-payment charge of the greater of (i) interest calculated at the lesser of (x) eighteen percent (18%) per year and (y) the maximum amount permitted by law and (ii) twenty-five dollars ($25). Such interest will accrue daily from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You will pay the interest immediately on demand. You will pay all collection costs incurred by NEC (including, without limitation, reasonable attorneys’ fees).

If charges to Your automated payment account fail, NEC Intermedia will email a warning to Your Account billing contacts. (c) If NEC Intermedia is unable to successfully process Your payment by automated means by the seventh (7th) calendar day of the month for which the payment is due, Your payment will be considered late and not paid in full. NEC Intermedia may suspend or terminate Your Account in accordance with Section 2.3(b)(i) for failure to timely pay in full. By providing NEC [COP] with the automated payment information, You authorize NEC [COP] to charge Your automated payment account for any amounts arising from or relating to the Services without further authorization from You. It is Your responsibility to keep Your automated payment information up-to-to- date. If charges to Your automated payment account fail, NEC [COP] will email a warning to Your Account billing contacts. (c) If NEC [COP] is unable to successfully process Your payment by automated means by the seventh (7th) calendar day of the month for which the payment is due, Your payment will be considered late and not paid in full. NEC [COP] may suspend or terminate Your Account in accordance with Section 2.3(b)(i) for failure to timely pay in full. Late payments are subject to a late-payment charge of the greater of (i) interest calculated at the lesser of (x) eighteen percent (18%) per year and (y) the maximum amount permitted by law and (ii) twenty-five dollars ($25). Such interest will accrue daily from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You will pay the interest immediately on demand. You will pay all collection costs incurred by NEC [COP] (including, without limitation, reasonable attorneys’ fees).

You are responsible for and agree to update NEC Company with any changes to Your billing and/or automated payment information (e.g., new or updated credit card, credit card expiration date or other payment bank account information). By providing NEC Company with the automated payment information, You authorize NEC Company to charge Your automated payment account for any amounts arising from or relating to the Services without further authorization from You. It is Your responsibility to keep Your automated payment information up-to-date. If charges to Your automated payment account fail, NEC Company will email a warning to Your Account billing contacts. (c) If NEC Company is unable to successfully process Your payment by automated means by the seventh (7th) calendar day of the month for which the payment is due, Your payment will be considered late and not paid in full. NEC Company may suspend or terminate Your Account in accordance with Section 2.3(b)(i) for failure to timely pay in full. Late payments are subject to a late-payment charge of the greater of (i) interest calculated at the lesser of (x) eighteen percent (18%) per year and (y) the maximum amount permitted by law and (ii) twenty-five dollars ($25). Such interest will accrue daily from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You will pay the interest immediately on demand. You will pay all collection costs incurred by NEC byCompany (including, without limitation, reasonable attorneys’ fees).

(c) If NEC Intermedia is unable to successfully process Your payment by automated means by the seventh (7th) calendar day of the month for which the payment is due, Your payment will be considered late and not paid in full. NEC Intermedia may suspend or terminate Your Account in accordance with Section 2.3(b)(i) for failure to timely pay in full. (b) You must provide NEC Unetek with valid automated payment information as a condition to receive or use the Services. You are responsible for and agree to update NEC Unetek with any changes to Your billing and/or automated payment information (e.g., new or updated credit card, credit card expiration date or other payment account information). By providing NEC Unetek with the automated payment information, You authorize NEC Unetek to charge Your automated payment account for any amounts arising from or relating to the Services without further authorization from You. It is Your responsibility to keep Your automated payment information up-to-date. If charges to Your automated payment account fail, NEC Unetek will email a warning to Your Account billing contacts. (c) If NEC Unetek is unable to successfully process Your payment by automated means by the seventh (7th) calendar day of the month for which the payment is due, Your payment will be considered late and not paid in full. NEC Unetek may suspend or terminate Your Account in accordance with Section 2.3(b)(i) for failure to timely pay in full. Late payments are subject to a late-payment charge of the greater of (i) interest calculated at the lesser of (x) eighteen percent (18%) per year and (y) the maximum amount permitted by law and (ii) twenty-five dollars ($25). Such interest will accrue daily from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You will pay the interest immediately on demand. You will pay all collection costs incurred by NEC Unetek (including, without limitation, reasonable attorneys’ fees).

(b) You must provide NEC TPE with valid automated payment information as a condition to receive or use the Services. You are responsible for and agree to update NEC TPE with any changes to Your billing and/or automated payment information (e.g., new or updated credit card, credit card expiration date or other payment account information). By providing NEC TPE with the automated payment information, You authorize NEC TPE to charge Your automated payment account for any amounts arising from or relating to the Services without further authorization from You. It is Your responsibility to keep Your automated payment information up-to-date. If charges to Your automated payment account fail, NEC TPE will email a warning to Your Account billing contacts. (c) If NEC TPE is unable to successfully process Your payment by automated means by the seventh (7th) calendar day of the month for which the payment is due, Your payment will be considered late and not paid in full. NEC TPE may suspend or terminate Your Account in accordance with Section 2.3(b)(i) for failure to timely pay in full. Late payments are subject to a late-payment charge of the greater of (i) interest calculated at the lesser of (x) eighteen percent (18%) per year and (y) the maximum amount permitted by law and (ii) twenty-five dollars ($25). Such interest will accrue daily from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You will pay the interest immediately on demand. You will pay all collection costs incurred by NEC TPE (including, without limitation, reasonable attorneys’ fees).

On or about the first (1st) day of each month, NEC Office Connection will apply the current monthly charges to Your automated payment method, the relevant information of which You entered on the billing information page in the administrative control panel. Payment by automated means includes any form of automated payment accepted by NEC Office Connection from time to time, including credit card, debit card, direct debit or other means. (b) You must provide NEC Office Connection with valid automated payment information as a condition to receive or use the Services. You are responsible for and agree to update NEC Office Connection with any changes to Your billing and/or automated payment information (e.g., new or updated credit card, credit card expiration date or other payment account information). By providing NEC Office Connection with the automated payment information, You authorize NEC Office Connection to charge Your automated payment account for any amounts arising from or relating to the Services without further authorization from You. It is Your responsibility to keep Your automated payment information up-to-date. If charges to Your automated payment account fail, NEC Office Connection will email a warning to Your Account billing contacts. (c) If NEC Office Connection is unable to successfully process Your payment by automated means by the seventh (7th) calendar day of the month for which the payment is due, Your payment will be considered late and not paid in full. NEC Office Connection may suspend or terminate Your Account in accordance with Section 2.3(b)(i) for failure to timely pay in full. Late payments are subject to a late-payment charge of the greater of (i) interest calculated at the lesser of (x) eighteen percent (18%) per year and (y) the maximum amount permitted by law and (ii) twenty-five dollars ($25). Such interest will accrue daily from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You will pay the interest immediately on demand. You will pay all collection costs incurred by NEC Office Connection (including, without limitation, reasonable attorneys’ fees).

On or about the first (1st) day of each month, NEC Voice Services will apply the current monthly charges to Your automated payment method, the relevant information of which You entered on the billing information page in the administrative control panel. Payment by automated means includes any form of automated payment accepted by NEC Voice Services from time to time-to-time, including credit card, debit card, direct debit or other means. (b) You must provide NEC Voice Services with valid automated payment information as a condition to receive or use the Services. You are responsible for and agree to update NEC Voice Services with any changes to Your billing and/or automated payment information (e.g., e.g. new or updated credit card, credit card expiration date or other payment account information). By providing NEC Voice Services with the automated payment information, You authorize NEC Voice Services to charge Your automated payment account for any amounts arising from or relating to the Services without further authorization from You. It is Your responsibility to keep Your automated payment information up-to-date. If charges to Your automated payment account fail, NEC Voice Services will email a warning to Your Account billing contacts. (c) If NEC Voice Services is unable to successfully process Your payment by automated means by the seventh (7th) calendar day of the month for which the payment is due, Your payment will be considered late and not paid in full. NEC Voice Services may suspend or terminate Your Account in accordance with Section 2.3(b)(i2.3(b)(1) for failure to timely pay in full. Late payments are subject to a late-payment charge of the greater the greater of (i) interest calculated at the lesser of (x) 18% (eighteen percent (18%percent) per year and (y) the maximum amount permitted by law and and (ii) $25 (twenty-five dollars ($25dollars). Such interest will accrue daily from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You will pay the interest immediately on demand. You will pay all collection costs incurred by NEC Voice Services (including, without limitation, reasonable attorneys’ attorney’s fees).

By providing NEC Intermedia with the automated payment information, You authorize NEC Intermedia to charge Your automated payment account for any amounts arising from or relating to the Services without further authorization from You. It is Your responsibility to keep Your automated payment information up-to-date. If charges to Your automated payment account fail, NEC Intermedia will email a warning to Your Account billing contacts. (c) If NEC Intermedia is unable to successfully process Your payment by automated means by the seventh (7th) calendar day of the month for which the payment is due, Your payment will be considered late and not paid in full. NEC Intermedia may suspend or terminate Your Account in accordance with Section 2.3(b)(i) for failure to timely pay in full. Late payments are subject to a late-payment charge of the greater of (i) interest calculated at the lesser of (x) eighteen percent (18%) per year and (y) the maximum amount permitted by law and (ii) twenty-five dollars ($25)pounds. Such interest will accrue daily from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You will pay the interest immediately on demand. You will pay all collection costs incurred by NEC Intermedia (including, without limitation, reasonable attorneys’ fees).

(b) You must provide NEC Constructure with valid automated payment information as a condition to receive or use the Services. You are responsible for and agree to update NEC Constructure with any changes to Your billing and/or automated payment information (e.g., e.g. new or updated credit card, credit card expiration date or other payment account information). By providing NEC Constructure with the automated payment information, You authorize NEC Constructure to charge Your automated payment account for any amounts arising from or relating to the Services without further authorization from You. It is Your responsibility to keep Your automated payment information up-to-date. If charges to Your automated payment account fail, NEC Constructure will email a warning to Your Account billing contacts. (c) If NEC Constructure is unable to successfully process Your payment by automated means by the seventh (7th) calendar day of the month for which the payment is due, Your payment will be considered late and not paid in full. NEC Constructure may suspend or terminate Your Account in accordance with Section 2.3(b)(i) for failure to timely pay in full. Late payments are subject to a late-payment charge of the greater the greater of (i) interest calculated at the lesser of (x) eighteen percent (18%) per year and (y) the maximum amount permitted by law and (ii) twenty-twenty- five dollars ($25). Such interest will accrue daily from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You will pay the interest immediately on demand. You will pay all collection costs incurred by NEC Constructure (including, without limitation, reasonable attorneys’ fees).

On or about the first (1st) day of each month, NEC Xband Enterprises will apply the current monthly charges to Your automated payment method, the relevant information of which You entered on the billing information page in the administrative control panel. Payment by automated means includes any form of automated payment accepted by NEC Xband Enterprises from time to timetime‐to‐time, including credit card, debit card, direct debit or other means. (b) You must provide NEC Xband Enterprises with valid automated payment information as a condition to receive or use the Services. You are responsible for and agree to update NEC Xband Enterprises with any changes to Your billing and/or automated payment information (e.g., e.g. new or updated credit card, credit card expiration date or other payment account information). By providing NEC Xband Enterprises with the automated payment information, You authorize NEC Xband Enterprises to charge Your automated payment account for any amounts arising from or relating to the Services without further authorization from You. It is Your responsibility to keep Your automated payment information up-to-date. If charges to Your automated payment account fail, NEC will email a warning to Your Account billing contacts.automated (c) If NEC Xband Enterprises is unable to successfully process Your payment by automated means by the seventh (7th) calendar day of the month for which the payment is due, Your payment will be considered late and not paid in full. NEC Xband Enterprises may suspend or terminate Your Account in accordance with Section 2.3(b)(i) for failure to timely pay in full. Late payments are subject to a late-late‐ payment charge of the greater the greater of (i) interest calculated at the lesser of (x) eighteen percent (18%) per year and (y) the maximum amount permitted by law and (ii) twenty-five twenty‐five dollars ($25). Such interest will accrue daily from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You will pay the interest immediately on demand. You will pay all collection costs incurred by NEC Xband Enterprises (including, without limitation, reasonable attorneys’ fees).

It is Your responsibility to keep Your automated payment information up-to-date. If charges to Your automated payment account fail, NEC [COP] will email a warning to Your Account billing contacts. (c) If NEC [COP] is unable to successfully process Your payment by automated means by the seventh (7th) calendar day of the month for which the payment is due, Your payment will be considered late and not paid in full. NEC [COP] may suspend or terminate Your Account in accordance with Section 2.3(b)(i) for failure to timely pay in full. Late payments are subject to a late-payment charge of the greater of (i) interest calculated at the lesser of (x) eighteen percent (18%) per year and (y) the maximum amount permitted by law and (ii) twenty-five dollars Euro/Pounds Sterling ($25€/£25) (or equivalent amount in any other currency as may be permitted by NEC). Such interest will accrue daily from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You will pay the interest immediately on demand. You will pay all collection costs incurred by NEC [COP] (including, without limitation, reasonable attorneys’ fees).

NEC may suspend or terminate Your Account in accordance with Section 2.3(b)(i) for failure to timely pay in full. Late payments are subject to a late-payment charge of the greater of (i) interest calculated at the lesser of (x) eighteen ten percent (1810%) per year and (y) the maximum amount permitted by law and (ii) twenty-five dollars ($25). Such interest will accrue daily from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You will pay the interest immediately on demand. You will pay all collection costs incurred by NEC (including, without limitation, reasonable attorneys’ fees).

Payment by automated means includes any form of automated payment accepted by NEC nearData from time to time, including credit card, debit card, direct debit or other means. (b) You must provide NEC nearData with valid automated payment information as a condition to receive or use the Services. You are responsible for and agree to update NEC nearData with any changes to Your billing and/or automated payment information (e.g., new or updated credit card, credit card expiration date or other payment account information). By providing NEC nearData with the automated payment information, You authorize NEC nearData to charge Your automated payment account for any amounts arising from or relating to the Services without further authorization from You. It is Your responsibility to keep Your automated payment information up-to-date. If charges to Your automated payment account fail, NEC nearData will email a warning to Your Account billing contacts. (c) If NEC nearData is unable to successfully process Your payment by automated means by the seventh (7th) calendar day of the month for which the payment is due, Your payment will be considered late and not paid in full. NEC nearData may suspend or terminate Your Account in accordance with Section 2.3(b)(i) for failure to timely pay in full. Late payments are subject to a late-payment charge of the greater of (i) interest calculated at the lesser of (x) eighteen percent (18%) per year and (y) the maximum amount permitted by law and (ii) twenty-five dollars ($25). Such interest will accrue daily from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You will pay the interest immediately on demand. You will pay all collection costs incurred by NEC nearData (including, without limitation, reasonable attorneys’ fees).

Payment by Automated Means. (a) You may view and print an invoice for Your Account using the administrative control panel made available to You. On or about the first (1st) day of each month, NEC Intermedia will apply the current monthly charges to Your automated payment method, the relevant information of which You entered on the billing information page in the administrative control panel. By providing NEC Intermedia with the automated payment information, You authorize NEC authorise Intermedia to charge Your automated payment account for any amounts arising from or relating to the Services without further authorization authorisation from You. It is Your responsibility to keep Your automated payment information up-to-date. If charges to Your automated payment account fail, NEC Intermedia will email a warning to Your Account billing contacts. (c) If NEC Intermedia is unable to successfully process Your payment by automated means by the seventh (7th) calendar day of the month for which the payment is due, Your payment will be considered late and not paid in full. NEC then Intermedia, without limiting its remedies under this Agreement, may suspend or terminate Your Account in accordance with Section 2.3(b)(i) for failure to timely pay in full. Late payments are subject to a late-payment charge of You interest on the greater of (i) interest calculated overdue amount at the lesser rate of (x) eighteen percent (18%) 4% per year and (y) the maximum amount permitted by law and (ii) twenty-five dollars ($25)annum above HSBC Bank plc’s base lending rate from time to time. Such interest will shall accrue daily from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You will shall pay the interest immediately on demand. Notwithstanding the provisions of this paragraph, Intermedia may at its discretion claim in the alternative interest under the Late Payment of Commercial Debts (Interest) Xxx 0000. You will pay all collection costs incurred by NEC Intermedia (including, without limitation, reasonable attorneys’ legal fees).
