Payment Deductions. Employer shall be entitled to withhold from any compensation, benefits or amounts payable under this Agreement all applicable federal, state and local income taxes, social security payments, health, retirement or other benefit plan payments and other customary payroll deductions.
Payment Deductions. Marathon shall be entitled to deduct, from any sum or sums owing to Consultant hereunder, any amounts owed by Consultant to Marathon, and amounts due or to become due Marathon arising out of indemnification, if applicable, and to withhold from sums due Consultant hereunder any amount necessary to protect Marathon against Consultant's failure to pay indebtedness outstanding against the services performed hereunder and against any loss or damage by reason of any default of Consultant. In the event that Marathon disputes any item on a particular invoice, Marathon shall be entitled to withhold from payment, without payment of interest, the amount in dispute, until such time as Marathon is satisfied as to the disputed item.
Payment Deductions. 8.1 The Company will sample at least 1 plot per 2.5ha of the operation. Bounded plots will be used to calculate the residual stocking (stems/ha), poor quality will also be recorded. The Contractor may witness these plots.
8.2 The Company will assign demerit points at its discretion for poor quality on the following basis:

A. Work required in the General or Technical Provisions which is: not performed, not performed to the standards set forth therein, not performed at or within the time(s) specified therein, or is incomplete.
B. Claims filed or reasonable evidence indicating probable filing of claims by laborers, materialmen, subcontractors, or third parties.

Payment Deductions. (a) MMPDm−1,y = the Monthly Maintenance Payment Deduction (MMPD) for any Month (m-1) in Calendar Year (y) during the Term shall be calculated as follows: MMPDm−1,y = ∑(NCPV × NCPm−1 ) where:
(i) NCPV = the unit value of $25 for each Noncompliance Point accrued during Month (m), subject to indexation in accordance with Section 2.2 (Indexation) of this Schedule 8 (Payment Mechanism); and

(b) MRFm-1 = Monthly Royalty Fee for Month (m-1), calculated in accordance with the following formula:

Epicormics/Needles DEMERIT POINTS = 5 If more than one fault occurs on a tree than the maximum number of demerit points for that tree is equal to the single highest fault. In other words, if a tree has one or many of the same fault, for example, epicormics, the demerit points are a total of 5. Furthermore, if a tree has one or many multiple faults, for example 1 branch, 3 epicormics and is a reject selection, the demerit points are 10 (Reject selection is the single highest fault). If the total demerit points equal 20, then the Contractor may receive written advice from the Company to rework the area before payment is made. The Company will determine the size of the rework area. The size of the rework area will reflect the number of plots i.e. 2 plots per 5 hectares. The Company may charge the Contractor for the cost of replotting the area. The Contractor will be advised in writing before this deduction from payment is made. The Company shall have the right to stand down the Contractor and cancel the contract if demerits continue or damage to pruned crop becomes excessive. Lastly, the Company may withhold payment if the appropriate documentation related to the prescription (e.g. FSC documentation, payment requests) are not provided prior to the mark up dates specified for Forestry Contractor Payments.
