PAYMENT EXCLUSIONS. City shall not be liable for cost associated with design revisions necessary to obtain the LEED Silver rating. Consultant shall be liable for construction costs incurred due to revision of drawing necessary to obtain LEED Silver rating. Where the Project fails to obtain a LEED Silver rating due to errors or omissions in the design or where the Consultant fails to perform the required Scope of Work under this Agreement, the City shall be entitled to recover all costs relating to the LEED Certification.
