Common use of Payment in Installments Clause in Contracts

Payment in Installments. All assessments and premiums which are not specifically charged to Tenant because of what Tenant has done, which can be paid by Landlord in installments without the imposition of fees, penalties or interest, shall be paid by Landlord in the maximum number of installments that are permitted by law without the imposition of fees, penalties or interest and not included as Operating Expenses except in the Expense Year in which the assessment or premium installment is actually paid; provided, however, that if the prevailing practice in comparable first-class office buildings in the Central San Diego County area is to pay such assessments or premiums on an earlier basis, and Landlord pays on such earlier basis, such assessments or premiums shall be included in Operating Expenses in the Calendar Year that such assessments or premiums are paid by Landlord.
