Payment of funds to the Contractor. (a) Where this clause 9 applies, Item 5 sets out the maximum funding which the PHN makes available to the Contractor. (b) The PHN may in its absolute discretion defer, reduce or avoid all or part of a payment under Item 5 if it is reasonably satisfied that sufficient funds remain to be spent or Committed. (c) The Contractor acknowledges that it may be paid part (or all) of the Payments in advance of performing the Services to which that part of the Payments relates.
