PAYMENT OF INTEREST MANDATORY. In the event of any breach on the part of either party, the defaulting party will have to pay interest wherever the same is provided in the Agreement without fail. For instance, if the Promoter fails to give possession at the mentioned time, the Promoter will also pay interest at the said rate. You cannot get interest waiver since we also have to pay interest to the bank for construction loan and we also have to pay you interest due to delay in possession so we will not be able to waive off interest if levied in your account due to late payment. The Allottee agrees to pay to the Promoter interest on all amounts including the Total consideration or any part thereof payable by the Allottee to the Promoter under the terms of this Agreement from the date of said amount becoming due and payable by the Allottee till the date of realization of such payment. The Allottee confirms that the payment of interest by the Allottee shall be without prejudice to the other rights and remedies of the Promoter and shall not constitute a waiver of the same.
