Common use of Payment of Other Expenses Clause in Contracts

Payment of Other Expenses. In the event that the leasing transaction contemplated by this Participation Agreement fails to close as a result of the Owner Participant's failure to negotiate in good faith or to satisfy on or prior to May 7, 1998 any of the conditions to closing specified in Section 5 which are required to be satisfied by the Owner Participant on or prior to the Delivery Date, the Owner Participant will be responsible for all of its fees and expenses, including but not limited to the fees, expenses and disbursements of its special counsel. In the event that the leasing transaction contemplated by this Participation Agreement fails to close for any other reason Lessee will be responsible for such fees and expenses.

In the event that the leasing transaction contemplated by this Participation Agreement fails to close for any other reason Lessee will be responsible for such fees and expenses.

In the event that the leasing transaction contemplated by this Participation Agreement fails to close for any other reason Lessee will be responsible for such fees and expenses.
